There were several points of contention on how our process is structured and how Mr. and Mrs. Devine wanted to structure our process – both throughout the build process and post-closing. During the build process, there were several instances in which we were forced to change our process to accommodate requests and demands made by Mr. and Mrs. Devine as well as a level of distrust from the start of construction through close. Several times throughout the build, as well as in the period of which we were attempting to complete exterior work that was on hold from winter conditions, the customer independently hired contractors to complete work on the home without our consent or knowledge. These items included tree removals, burial of downspouts, landscaping, patio, trench drain, etc. Many of these items caused our team much trouble in getting work completed and final approvals from the village. For example, the trench drain that the customer had installed in the driveway was made of plastic and was not built to withstand the heat of an asphalt installation according to manufactures specifications. The customers independently hired landscape contractor also illegally dug in the yard without calling in a JULIE (utility locate). During this digging they struck and pulled up the main electrical service to the home.
Mr. and Mrs. Devine’s home has been 100% complete, yet Mr. and Mrs. Devine choose to not pay several thousand dollars that has been due and make claims that the work is not complete, yet refuse to give any documentation showing the incomplete work unless DJK pays them $200 per hour to do so. DJK has provided the Devine’s photos of each item showing 100% completion and have provided them a Full Certificate of Use and Occupancy for their home as approved by DuPage County Building Ordinance, Zoning Ordinance, and Health Ordinance. DJK has gone above and beyond to satisfy any concern of the Devine’s throughout the build and after the closing, yet still have not been paid in full. There is an arbitration clause in our construction agreement, so this will be the first time in 30 years that we will have to file an arbitration against a homeowner.
