We are surprised to read Mr. Akerman’s comments here, as our site manager worked extensively with Mr. Akerman throughout the entire process, responding quickly and openly on any and all issues.
Consequently, we believe that all of the facts related to this situation need to be addressed.
Mr. Akerman contacted us in March of 2017 regarding his project. However, he did not commit to the project by signing the contract and remitting the deposit until June 29th, due to the need for him to finalize several details.
Our installers began the project the week of August 14th – 6 weeks after the deposit for the project and well within the timeframe our site manager discussed with Mr. Akerman.
As sometimes happens during installations, 2 sections and 1 gate were not completed to our standards, nor was the fence painting completed as planned. We are not happy until issues like these are fully resolved to our standards and to the customer’s expectations. In this installation, it was necessary to make unplanned alterations to the fencing material which required re-installing a section, in addition to manufacturing a new double gate to replace the existing one which allowed for too large a gap between it and the ground.
Subsequent to the installation of the new gate, the post holding the gate shifted. On October 14th, we returned to change the post and to reset it. When the gate still failed to meet our standards, we returned in December to install longer poles with deeper footings, which caused the gate to function properly and as planned. In addition, we applied another coat of stain to the entire fence.
By December 16th, all improvements to the project had been completed. We understand this may have caused some frustration on Mr. Akerman’s part. However, because we stand behind the quality of our products and installation, we were committed not to leave the project until it was completed correctly.
In consideration for the inconvenience he experienced, Mr. Akerman proposed a substantial reduction in the final deposit owed, to which we responded with a more reasonable discount. Dissatisfied with our response, Mr. Akerman refused to remit any payment and threatened retribution via social media postings.
We were disappointed in these actions by Mr. Akerman, and were forced to resort to a mechanic’s lien on the property to secure our final payment in full – which is well within company policy and our contractual rights. Six weeks later on January 26, 2018, Mr. Akerman remitted payment less our proposed discount, which we are no longer in a position to extend due to the legal fees incurred as a result of his previous decision not to remit payment.
While the final outcome of this situation is pending, we were compelled to respond to Mr. Akerman’s posting so that all of the facts were presented.
