It took me 40 years in this business to come across my first “Karen” complaint.
In continuing let us set the foundation for your post.
Some things to consider, 2023 was compared to one of the worst rain seasons in the
history of weather recording. And yes your contract was $178,000
with thirty three percent being donated by vendors.
I was transparent and highlighted in my bid and contract the portions you would receive change orders for dumpsters, tree work, non-slip process for slabs and unforeseen.
You neglected to mention the design change you requested upon the commencement.
adding twenty five percent of custom slab fabrication for your pool and/or the changes with
tree removals creating additional grading issues and plantings that you requested larger specimens. These combined with the selection of glass tile for your pool.
The unforeseen as we exposed during demo were related to an undersized non-conforming.
gas line using standard white PVC fittings that were failing as well as a decomposed electrical.
service that had all wires exposed in several locations. An undersized water mainline was recommended to be upgraded at the same time to increase water flow to the back yard.
As we continued, we observed your sump pumps were set into catch basins, not even close to the proper vaults required for operation of your drainage system. Thus, another unforeseen required change order.
The plans for the pool, engineering, first- and second-generation masonry and landscape were all based in CAD. It was there after the plans were presented in hand drawn layouts as you were advised Kevin our draftsman had to go through extensive treatment to overcome his illness.
Approved change orders totaled $39,864
Broken down into three sections:
1.General conditions contract change orders-$5,825 (high lit in contract)
2.Unforeseen change orders-$18,505
3.Client requested change orders-$15,534
These amounts are a far cry from your over exaggeration. Your complaint does not acknowledge the twenty five percent coping construction, the fifteen percent additional pavers installation and the reworked irrigation system with a new valve manifold done for no additional cost.
Our billings were billed after the fact so of course we are asking for payments and trying collect for work and/or supplies purchased. The process to final your project was requested by you so the subcontractors (that you had their phone numbers already) were contacted by you for payments.
We refunded upon final all that you requested although not required by terms of your contract.
You were clear on stating for me to finish the masonry and fill pool to contract, which we fulfilled and
that any other services would “Not” be required.
The slip coefficient for the slab construction pool coping (your unsafe accusation) was to be additional as stated in contract and bid. Your issue is now “You” need to locate a company that is knowledgeable with this custom construction process. So after you “fired” us this brought our experience and knowledge to an end for your property.
I designed a great layout with incredible infrastructure using the highest standards and materials.
I wish you the best on completing your project and enjoying your pool and landscape for many years.
After forty years in the business, I do wish I ended my construction career on a nicer note, but I did not hide the fact that my career was ending shortly due to a variety of reasons.
